These Terms of Service (“Terms”) govern your use of the HomeStart mobile application, related websites, and online services (together, the “Services”) provided by HomeStart (“we,” “us,” “our”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy explains how we collect and use personal information and is incorporated by reference.

1. The Services

HomeStart offers financial planning, savings tracking, and educational tools to help you prepare to buy a home. The Services may include optional bank account linking through Plaid. We may update, modify, or discontinue features over time.

2. Not professional advice; not a lender

The Services are not financial, legal, tax, or real-estate advice. We are not a mortgage lender, broker, or credit decision-maker. Estimates shown in the app (including payments, PMI-style figures, debt-to-income-style ratios, and cash-to-close totals) are illustrative only and may differ from lender underwriting, actual taxes, insurance, or closing costs. You are solely responsible for decisions you make with lenders and other professionals.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract. You may not use the Services where doing so is prohibited by law.

4. Account registration and security

You must provide accurate registration information and keep it current. You are responsible for activity under your account and for safeguarding your credentials and device. We recommend using device passcodes and, where offered, biometric lock on devices you control.

5. Plaid and financial institutions

Optional linking is provided by Plaid Inc. and is subject to Plaid’s terms and privacy policy. We are not responsible for outages, errors, or acts of your financial institution or Plaid. You may stop linking or remove connections using in-app controls, subject to short technical delays.

6. Acceptable use

You agree not to misuse the Services, including by: attempting unauthorized access to our systems or other users’ data; interfering with or disrupting the Services; reverse engineering except as permitted by applicable law; using automated means to access the Services in a way that imposes an unreasonable load; or using the Services for any unlawful purpose.

7. Intellectual property

We and our licensors own the Services, including software, branding, and content (excluding your own information). We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, in accordance with these Terms.

8. Third-party services

The Services rely on third parties (for example, Google Firebase, Apple, Plaid, and sign-in providers such as Google or Meta/Facebook). Their terms and policies may apply to you. We are not responsible for third-party services we do not control.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IF THE SERVICES ARE PROVIDED WITHOUT CHARGE, OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

You agree to defend, indemnify, and hold harmless HomeStart and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any third party’s rights. We may assume exclusive defense of any matter subject to your indemnification, at your expense.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if we must do so to comply with law, or if we discontinue the Services. Provisions that by their nature should survive (including disclaimers, limitations of liability, indemnity, and governing law) will survive termination.

13. Governing law; disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Subject to applicable mandatory laws in your jurisdiction, you and we agree that the state and federal courts located in Delaware will have exclusive jurisdiction for disputes arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction there. If you are a consumer, nothing in this section limits rights you may have under the laws of your country of residence.

14. Changes

We may modify these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. If changes are material, we will provide additional notice as appropriate (for example, in-app notice or email). Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.

15. General

If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
